Tuesday, March 16, 1993 The Fresno Bee Melvin Swig, real estate, hotel owner; Michael Kanin, playwright, screenwriter Associated Press SAN FRANCISCO Melvin Swig, who headed a family owned real estate company with holdings that include the Fairmont Hotel chain, died of cancer on Sunday. He was 75. Mr. Swig, chairman of the board of Swig Weiler and Dinner Development Company, was the son of the late Benjamin Swig. The father died in 1980 after putting together a real estate empire that included the Fairmont Hotel, which sits atop Nob Hill.

In addition tot the San Francisco landmark, the company owns Fairmont Hotels in New Orleans, Dallas, Chicago and San Jose along with office towers and other holdings in several major cities, including New York, Washington D.C., and Houston. Mr. Swig was also active in funding the Democratic Party and was a delegate to several Democratic National conventions. He was a noted philanthropist and a leader in the Jewish community. "I love the fact that I can be talking about hotels one minute, real estate the next and charities after that," he once told an interviewer.

He served as chairman of the Board of the University of San Francisco where he established the Melvin M. Swig Judaic Studies program. An avid sports fan, he once owned the now defunct California Golden Seals hockey team. Survivors include his wife, sons Steve, Kent and Robert, brother Richard, and three grandchildren. MICHAEL KANIN: Michael Kanin, a playwright and screenwriter who shared an Oscar in 1942 for the Katharine HepburnSpencer Tracy film classic "Woman of the Year," has died. He was 83.

Mr. Kanin, the younger brother of writer Garson Kanin, died Friday at Cedars-Sinai Medical Center, the Academy of Motion Picture Arts and Sciences said. Cause of death was not disclosed. Mr. Kanin shared the Academy Award with Ring Lardner Jr.

LUCILLE D. POTEET Services for Lucille D. Poteet, 78, of Los Banos, will be held at 10 a.m. Wednesday at Whitehurst Mr. Kanin went on to direct, produce and write many successful films and Broadway plays, most frequently with his wife, Fay Mitchell Kanin.

Their film credits included "Sunday Punch," "The Opposite Sex" and "Rhapsody," starring Elizabeth Taylor. They also wrote "Teacher's Pet," starring Clark Gable and Doris Day, which was nominated for an Oscar for best original screenplay. Their Broadway hits included "Rashom*on" and the musical "The High Life." Mr. Kanin's career was intertwined with his brother's work. He produced "A Double starring Ronald Colman and written by Garson Kanin and his wife, writer -actress Ruth Gordon.

The 1947 film received four Oscar nominations and won two Oscars. Born in Rochester, N.Y., on Feb. 1, 1910, Mr. Kanin moved to New York City with his family as a child. He studied at the Arts Students League and the New York School of Design while working summers with his brother on the "borscht circuit," writing, producing and singing in shows at Catskill Mountain hotels.

During the Depression, he painted stage scenery for burlesque shows, but an eye injury led him to switch to writing. He is survived by his wife, a son, Josh, and two granddaughters. after 6 p.m. Punch in 2102 on your Los Banos Funeral Chapel. Mrs.

By Bob Egelko Associated Press SAN FRANCISCO The state Supreme Court gave landowners broad immunity Monday from suits by strangers injured on their property while hiking, camping or engaged in any other recreational activity.

Overturning nine lower-court decisions, the court ruled 4-3 that an uninvited, non-paying recreational user of private property can sue only for malicious misconduct even if the property is a construction site not normally suited for recreational use. State law normally allows even trespassers to sue for injuries caused by dangerous conditions, but bars negligence suits stemming from recreational use of the land, an exception intended both to protect landowners and to encourage them to leave their property open. Recreational users can sue only in one of three situations: if they were invited, if they had paid a fee or if they were victims of malicious misconduct.
